Welcome to ImageWizard! These Terms and Conditions ("Terms") govern your use of the ImageWizard website and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Use of Services

Users under the age of 13 are prohibited from using ImageWizard without verifiable parental consent. If you are under 18, you must obtain permission from a parent or guardian before using our Services.

You agree to use our Services only for lawful purposes and in compliance with these Terms.

We reserve the right to permanently suspend or terminate accounts that violate our policies, which may result in the loss of credits. Users may appeal suspensions or terminations by contacting support, but there is no guaranteed timeframe for resolution.

New users may receive a one-time free sample. This offer does not renew monthly. Each user is entitled to one free sample per lifetime. Attempts to bypass this restriction, including creating multiple accounts, may result in account suspension or termination.

2. User Accounts

Users must sign in using their Google account.

The following information is stored in user accounts:

• Email address
• IP address (Your IP address is used solely for security purposes, such as detecting duplicate accounts and preventing fraudulent activities. It is stored as long as your account remains active.)
• Image credits quantity and related data
• Generated images history

Users are responsible for maintaining the confidentiality of their Google account credentials and are liable for all activities under their account.

ImageWizard is not responsible for unauthorized access resulting from failure to secure login details.

You agree to notify us immediately of any unauthorized use of your account.

3. Payments

Credits on ImageWizard are purchased through one-time payments. Users can choose how many credits they wish to buy at checkout. Prices may vary depending on quantity and promotional offers.

Payments are securely processed through Stripe. ImageWizard does not store your credit card information.

Tool Pricing:

• Each tool has a specific credit cost depending on its features and resource requirements. The number of credits required for each operation is clearly displayed prior to usage.
• Credits are deducted immediately upon successful generation or usage of any tool that requires payment.

Refunds:

• All credit purchases are final and non-refundable, including for unused or mistakenly purchased credits. Please ensure you confirm your credit quantity and cost before payment.
• Refunds will only be issued in the case of a verified technical error caused by ImageWizard that results in a failure to deliver credits after a successful payment.

4. Ownership & Copyright

Users retain full ownership of images they create using our Services. ImageWizard does not claim any rights or licenses over user-generated images, including for promotional use.

You may not upload or generate copyrighted content without proper authorization.

ImageWizard does not train AI models on user-generated images.

5. Prohibited Uses

You agree not to use ImageWizard for:

• Creating or distributing illegal, explicit, hateful, or misleading content.
• Generating realistic depictions of real individuals without their explicit consent, including deepfakes or unauthorized impersonations.
• Violating intellectual property laws or third-party rights.
• Engaging in AI-generated misinformation, harassment, or deceptive advertising.

6. Limitations of Liability

ImageWizard is provided "as is" without warranties of any kind.

• While we strive to maintain reliable Services, we are not liable for data loss due to technical failures, user errors, or service disruptions. Users are encouraged to download and back up important images.
• We are not responsible for loss of images, user-generated content, or account data due to service outages, accidental deletions, or technical issues.
• In no event shall ImageWizard be liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits or data. Our total liability shall not exceed the amount you paid for our Services in the three months preceding the claim.

7. Force Majeure

ImageWizard shall not be held liable for failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, cyberattacks, government actions, or technical failures outside our infrastructure.

8. Modifications to Terms

We may update these Terms from time to time.

Continued use of our Services after changes constitutes acceptance of the revised Terms.

9. Termination

We reserve the right to permanently suspend or terminate your access to ImageWizard for violations of these Terms, which may result in the loss of credits. Users may appeal suspensions or terminations by contacting support.

Terminated accounts may have associated data, including credits, permanently deleted.

You may cancel your account at any time by contacting [email protected]. If you wish to request a copy of your data before deletion, you must contact us prior to cancellation.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Dispute Resolution:

• Before initiating legal action, you agree to attempt resolution through good-faith mediation for at least 30 days.
• If mediation fails, disputes may be resolved in your local jurisdiction or through online dispute resolution mechanisms.

11. Indemnification

You agree to indemnify and hold ImageWizard, its affiliates, employees, and partners harmless from any claims, losses, damages, liabilities, or legal fees arising from your use of our Services or violation of these Terms, but only to the extent that it results from your actions.
